ICO enforcement notices against five public authorities

The Information Commissioner’s Office (ICO) has issued enforcement notices against five public authorities for continued failings to meet FOI obligations.

 

John Edwards, the Information Commissioner, has written an open letter to remind public organisations that transparency is essential and resources must be dedicated to access information.

 

Sussex Police and South Yorkshire Police had large backlogs of FOI requests – Sussex Police had 753 and South Yorkshire Police had 390. Sussex Police had a compliance rate of just 32% and South Yorkshire Police’s compliance rate was under 18%.

 

The Financial Services Ombudsman (FSO) and Department for Education (DfE) have shown inconsistency with FOI response times – FSO responding to only 65% of requests in 2022/23 and DfE’s response rate has been lower than 80% since 2019.

 

The Foreign, Commonwealth and Development Office had a consistently poor performance of time limits for responding to FOI requests. From July – September 2023 only 33% of requests were answered within the deadline and 55% within the extension.
