The Spanish Data Protection Agency (AEPD) approved, on October 9, the modification of the “Code of Conduct for Data Processing in Advertising Activity”.
This new modification of the Code of Conduct also introduces the possibility for entities adhering to it to use a badge on their web pages and other digital and physical media and supports, with the purpose of making public and highlighting their adherence to the Code of Conduct.
Likewise, this modification aims to adjust its wording to the new article 66.1 b) of Law 11/2022, of June 28, General Telecommunications (LGT), as well as Circular 1/2023, of June 26, on the application of the aforementioned article. In particular, it takes into account the necessary adjustments that this new legal provision imposes on the legality parameters for making commercial calls to clients and potential clients.
All of these changes are already in force, as the Code itself expressly provides that its modifications will be fully applicable the day after its approval.
In this way, the Code takes a new step to reinforce its role as a fundamental element of proactive responsibility and diligence in companies, while contributing to reducing administrative files and improving the image in front of authorities and consumers.
The Code, which came into force in January of this year, has 55 participating entities and, through the mediation unit, we have received more than 1,600 complaints so far this year, which has allowed us to demonstrate its proper functioning. of this.
The Code provides for a mechanism for resolving consumer complaints regarding data protection within the framework of an advertising activity – specialized, accredited, agile, low-cost and effective – that has the recognition of the AEPD and the Government (a through the recognition of the AUTOCONTROL Jury as ADR). Furthermore, it provides for the possibility that the AEPD may refer the claims it receives to AUTOCONTROL, reserving its intervention when it deems necessary; In this way they can reduce administrative files.
